澳門特別行政區法例 |
行政長官根據澳門特別行政區第3/1999號法律第五條(二)項及第六條第一款的規定,命令公佈《中華人民共和國澳門特別行政區政府與墨西哥合眾國政府互免簽證協定》。

獲得中華人民共和國中央人民政府正式授權簽訂本協定的中華人民共和國澳門特別行政區政府和墨西哥合眾國政府(以下簡稱“締約雙方”)﹔
為了加強相互間的友好合作關係;
簡化雙方人員的旅行手續;
達成以下協議:
持有效澳門特別行政區護照且非為任何受僱或從事專業者,應獲准免辦簽證進入、過境、逗留及離開墨西哥合眾國的任何國際性轉運站,逗留時間不超過連續九十(90)日。
持有效墨西哥合眾國普通護照且非為任何受僱或從事專業的國民,應獲准免辦簽證進入、過境、逗留及離開澳門特別行政區,逗留時間不超過連續九十(90)日。
(一)澳門特別行政區有效護照持有人為進入墨西哥合眾國多於九十(90)日或為受僱或從事專業的,應事先向墨西哥合眾國的有權限當局取得簽證。
(二)持有效普通護照的墨西哥合眾國國民為進入澳門特別行政區多於九十(90)日或為受僱或從事專業的,應事先向澳門特別行政區政府的有權限當局取得簽證。
締約雙方應在本協定生效前最少三十(30)日,透過外交途徑交換第一條及第二條所述之護照樣本及護照使用的相關資料。倘上述護照有任何更新,締約雙方應通知有關情況並在其啟用前最少三十(30)日互相提供新式樣的護照樣本。
本協定不免除第一條及第二條所述的締約一方有效的普通護照持有人應遵守由締約另一方有權限當局所要求的有關移民及所有其他法律法規的義務。
每一締約方的有權限當局可拒絕被認為不受歡迎的人進入或逗留在其境內,尤其對公眾秩序和衛生或安全可能造成危險的人,或其在當地屬非法的人。
締約雙方應以共同協議的方式解決任何由於理解或實施本協定所引起的爭論。
基於安全理由、公眾秩序或衛生保護,締約任一方可中止實施本協定全部或部份條款。中止的措施應即時透過外交途徑,以書面方式通知締約另一方,並清楚說明其生效的日期。
(一)本協定於簽署後三十(30)日生效。
(二)本協定可在締約雙方同意下,正式透過外交途徑,以書面方式作出修訂,有關修訂實施的有效期及其生效日期須在通知中清楚說明。
(三)本協定不設限期持續有效;締約任一方可終止本協定,但應在協定終止日前最少六十(60)日,透過外交途徑,以書面方式通知締約另一方。
於二零零八年九月十九日在澳門簽訂,一式兩份,每份分別用中文、西班牙文和英文寫成,三種文本同等作準。如在解釋上遇有分歧,以英文文本為準。

The Government of the Macao Special Administrative Region of the People’s Republic of China, having been duly authorized to conclude this Agreement by the Central People’s Government of the People’s Republic of China and the Government of the United Mexican States, (hereinafter referred to as «the Contracting Parties»);
ENCOURAGING to strengthen their friendship and cooperation relations;
DESIROUS to ease travel formalities between them;
Have agreed as follows:
Holders of a valid passport of the Macao Special Administrative Region and not intending to take up any employment or exercising a profession shall be authorized, with visa exemption, to enter, transit through, sojourn in and exit through any international transit point of the United Mexican States for a period not exceeding ninety (90) consecutive days.
Nationals of the United Mexican States holding a valid ordinary passport and not intending to take up any employment or exercising a profession shall be authorized, with visa exemption, to enter, transit through, sojourn in and exit of the Macao Special Administrative Region for a period not exceeding ninety (90) consecutive days.
1. Holders of a valid passport of the Macao Special Administrative Region intending to enter the United Mexican States for a period of time exceeding ninety (90) days or in order to take up employment or exercising a profession, shall obtain a visa in advance from the competent authorities of the United Mexican States.
2. Nationals of the United Mexican States holding a valid ordinary passport intending to enter the Macao Special Administrative Region for a period of time exceeding ninety (90) days or in order to take up employment or exercising a profession, shall obtain a visa in advance from the competent authorities of the Government of the Macao Special Administrative Region.
The Contracting Parties shall exchange through diplomatic channel, specimens of their passports specified in Articles 1 and 2, as well as relevant information relating to the use of those passports, at least thirty (30) days before this Agreement comes into force. In case of any modification in the aforementioned passports, the Contracting Parties shall inform so and provide each other samples of new passports, at least thirty (30) days before their introduction.
This Agreement does not exempt the holders of valid ordinary passports of one Contracting Party, mentioned in Article 1 and 2, from the obligation to comply with the migratory and all other legal regulations demanded by the competent authorities of the other Contracting Party.
The competent authorities of each Contracting Party may deny entry to or sojourn in its territory to persons who are considered as non grata, in particular persons who may present a risk to public order and health or security or whose presence within its territory is illegal.
Any dispute arising from the interpretation or application of this Instrument shall be settled by mutual agreement of the Contracting Parties.
Either Contracting Party may suspend totally or partially, the application of this Agreement for security reasons, public order or health protection. The suspension shall be immediately communicated, in writing, through diplomatic channel to the other Contracting Party, specifying the date in which shall enter into effect.
1. This Agreement shall enter into force thirty (30) days after the day of its signature.
2. This Agreement may be amended by mutual consent by the Contracting Parties, in writing, formalised through written communication from diplomatic channel in which the effective date of the amendment and its entry into force must be clearly specified.
3. This Agreement shall remain into force for an indefinite period of time. Nevertheless, either Contracting Party may terminate it upon written notification to the Other Contracting Party, through diplomatic channel, at least sixty (60) days before the expiration date.
Signed at Macao SAR, on the 19th day of September of two thousand and eight, in two originals in Chinese, Spanish and English languages, all texts being equally authentic. In case of divergence of interpretation the English text shall prevail.
