REGULATION (EEC) No 313/74 OF THE COUNCIL of 4 February 1974 concluding the two exchanges of letters relating to Articles 2 and 3 of Protocol No 8 of the Agreement between the European Economic Community and the Portuguese Republic
THE COUNCIL OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Economic Community, and in particular Article 113 thereof;
Having regard to the proposal from the Commission;
Having regard to the Agreement between the European Economic Community and the Portuguese Republic signed on 22 July 1972;
Whereas the provisions of the exchanges of letters of 20 December 1972 relating to Articles 2 and 3 of Protocol No 8 to the Agreement between the European Economic Community and the Portuguese Republic should be extended and the exchanges of letters to this effect, which took place on 30 January 1974, should be concluded,
HAS ADOPTED THIS REGULATION:
Article 1
The exchanges of letters relating to Articles 2 and 3 of Protocol No 8 of the Agreement between the European Economic Community and the Portuguese Republic are hereby concluded on behalf of the Community.
The texts of the exchanges of letters are annexed to this Regulation.
Article 2
This Regulation shall enter into force on the day following its publication in the Official Journal of the European Communities.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

EXCHANGE OF LETTERS relating to Article 2 of Protocol No 8 of the Agreement between the European Economic Community and the Portuguese Republic.
Letter No 1
Brussels, 30 January 1974
Sir,
Pursuant to Article 2 of Protocol No 8 of the Agreement between the European Economic Community and the Portuguese Republic signed on 22 July 1972, and following the declarations made by the two delegations at the second meeting of the EEC - Portugal Joint Committee held in Brussels on 13 November 1973, I hereby inform you that Portugal agrees to the extension to 31 January 1975 of the detailed arrangements contained in the exchange of letters of 20 December 1972 between Portugal and the Community relating to the conditions in accordance with which prepared and preserved sardines falling within heading No 16.04 D of the Common Customs Tariff are imported into the Community.
The Government of Portugal undertakes, moreover, to ensure that the prices charged for imports into the Community from 1 February 1974 shall not be less than the prices set out in the Annex hereto, and also to prevent any deflection of trade.

Your Excellency,
I hereby acknowledge receipt of your letter of today, worded as follows:
"Pursuant to Article 2 of Protocol No 8 of Agreement between the European Economic Community and the Portuguese Republic signed on 22 July 1972, and following the declarations made by the two delegations at the second meeting of the EEC-Portugal Joint Committee held in Brussels on 13 November 1973, I hereby inform you that the Portuguese Republic agrees to the extension to 31 January 1975 of the detailed arrangements contained in the exchange of letters of 20 December 1972 relating to the conditions in accordance with which prepared and preserved sardines falling within subheading No 16.04 D of the Common Customs Tariff are imported into the Community.
The Government of the Portuguese Republic undertakes, moreover, to ensure that the prices charged for imports into the Community from 1 February 1974 shall not be less than the prices set out in the Annex hereto, and also to prevent any deflection of trade."

Letter No 1

Sir,
Pursuant to Article 3 of Protocol No 8 of the Agreement between the European Economic Community and the Portuguese Republic, and following the declarations made by the two delegations at the second meeting of the EEC - Portugal Joint Committee held in Brussels on 13 November 1973, I hereby inform you that in view of the forthcoming introduction in the Community of common arrangements for trade with third countries in products processed from fruit and vegetables, Portugal agrees to the extension to 30 June 1974 at the latest, of the detailed arrangements contained in the exchange of letters of 20 December 1972 between Portugal and the Community relating to the conditions governing imports into the Community of tomatoes which are prepared or preserved otherwise than by vinegar or acetic acid and originate in and come from Portugal.
The Government of Portugal undertakes, moreover, to ensure that the prices charged for the imports into the Community from 1 February 1974 shall not be less than the prices set out in the Annex hereto, and also to prevent any deflection of trade.

I hereby confirm that the extension of the detailed arrangements contained in the above exchange of letters forms part of a provisional solution applicable until the introduction of common import arrangements which are to enter into force in the near future.
Were the entry into force of the common import arrangements to be delayed beyond 30 June 1974, the Community is prepared to lay down a rate of increase of the quantities for the period from 1 July 1974 to 31 December 1974 should that prove necessary in view of the state of the market, the term "state of the market" being taken in its widest sense, to cover also exports from the Community.
