AGREEMENT in the form of an exchange of letters amending the Agreement between the European Economic Community and Romania on trade in textile products

Letter N° 1

Sir,

1. I have the honour to refer to the consultations held on 19 and 20 September 1991 between the delegations of Romania and of the European Economic Community for the purpose of amending the Agreement on trade in textile products between the European Economic Community and Romania, initialled on 11 July 1986 and applied from 1 January 1987, and subsequently amended by the Agreed Minute initialled on 30 November 1990 and applied from 1 January 1991.

2. At the close of the consultations, both Parties agreed to amend Article 18 (1) and Protocol D of the Agreement in order to extend the application of all its provisions for one more year, until 31 December 1992. Consequently, the Parties also agreed to amend the following provisions of the Agreement:

- Annex II, with regard to the quantitative limits on Romanian exports to the Community of the textile products to which that Annex refers,

- the Annex to Protocol E, with regard to the quantitative limits on items reimported into the Community after working, finishing or processing in Romania.

The amended Annexes are attached (Appendix).

3. With regard to Article 13 (3) of the Agreement, the Parties agreed that the inter-regional transfer percentage for 1992 should be determined at a later stage.

4. The Parties also agreed that the extended Agreement should enter into force on 1 January 1992 and apply until 31 December 1992.

They agreed on de facto application of the Agreement from 1 January 1992.

5. I should be obliged if you would confirm that your Government is in agreement with the above.

Agreed Minute

At the close of the consultations held on 19 and 20 September 1991 between the Romanian and Community delegations for the purpose of amending the Agreement on trade in textile products between the European Economic Community and Romania, initialled on 11 July 1986 and applied from 1 January 1987, the Agreement in question was extended for one year, and the two Parties also agreed to determine for 1992 the levels of the quantitative limits appearing in table II of the Annex to the Agreement in the form of an exchange of letters, which is an integral part of the Agreement initialled on 11 July 1986.

The Annex, as amended, is attached to this Agreed Minute.

All the provisions of the extended Agreement apply to table II of the Annex to the Agreement in the form of an exchange of letters as amended by this Agreed Minute.

The Parties have agreed that this Minute should take effect on 1 January 1992 and apply until 31 December 1992. They have also agreed on de facto application of the Minute from 1 January 1992.

ANNEX (TABLE II) TO THE AGREEMENT IN THE FORM OF AN EXCHANGE OF LETTERS

The Directorate-General for External Relations of the Commission of the European Communities presents its compliments to the Romanian Mission to the European Communities and has the honour to refer to the Agreement between the European Economic Community and Romania on trade in textile products, initialled on 11 July 1986 and applied since 1 January 1987, as extended by the exchange of letters initialled on 20 September 1991.

The Directorate-General wishes to inform the Romanian Mission that pending the completion of the procedures necessary for the conclusion and entry into force of the extended Agreement, the Community is prepared to allow the provisions of the extended Agreement to apply de facto from 1 January 1992. This is on the understanding that either Party may at any time terminate the application of the extended Agreement provided that at least 90 days' notice is given.

The Directorate-General for External Relations would be obliged if the Romanian Mission would confirm that the Government of Romania is in agreement with the above.

The Directorate-General for External Relations of the Commission of the European Communities avails itself of this opportunity to renew to the Romanian Mission to the European Communities the assurance of its highest consideration.

Exchange of notes

The Romanian Mission to the European Communities presents its compliments to the Directorate-General for External Relations of the Commission of the European Communities and has the honour to refer to the Directorate-General's Note verbale concerning the Agreement between the European Economic Community and Romania on trade in textile products, initialled on 11 July 1986 and applied since 1 January 1987, as extended by the exchange of letters initialled on 20 September 1991.

The Romanian Mission wishes to confirm that pending the completion of the procedures necessary for the conclusion and entry into force of the extended Agreement, the Romanian Government is prepared to allow the provisions of the extended Agreement to apply de facto from 1 January 1992. This is on the understanding that either Party may at any time terminate the application of the extended Agreement provided that at least 90 days' notice is given.

The Directorate-General for External Relations of the Commission of the European Communities presents its compliments to the Mission of Romania to the European Communities and has the honour to refer to the Agreement between Romania and the European Community on trade in textile products, initialled on 11 July 1986 and applied since 1 January 1987, as amended by the exchange of letters initialled on 20 September 1991.

With reference to paragraph 3 of the abovementioned exchange of letters, the Directorate-General has the honour to inform the Mission that it is now in a position to propose the following paragraph:

'The percentage of transfers between regional quota-shares referred to in Article 13, paragraph 3 of the Agreement for the year 1992 shall be 40 %.

It is understood that if, as a result of the application of the above percentage, serious difficulties, following significant changes in the pattern of trade, occur in certain regions of the Community, both Parties shall hold consultations without delay with a view to reviewing the situation.`

The Directorate-General for External Relations would be grateful if the authorities of Romania would confirm their acceptance of the above adaptation of the Agreement, as agreed at the time of initialling of the said exchange of letters.

The Directorate-General for External Relations of the Commission of the European Communities avails itself of this opportunity to renew to the Mission of Romania to the European Communities the assurance of its highest consideration.

Note verbale

The Mission of Romania to the European Communities presents its compliments to the Directorate-General for External Relations of the Commission of the European Communities and has the honour to refer to the Note verbale No 19051 of 25 October 1991 concerning paragraph 3 of the exchange of letters initialled on 20 September 1991, which provided for the extension to 1992 of the Agreement between Romania and the European Community on trade in textile products.

With reference to paragraph 3 of the abovementioned exchange of letters, the Mission of Romania has the honour to inform the Directorate-General that the Romanian authorities agree to the proposed formulation of the said paragraph, i.e.:

'The percentage of transfers between regional quota-shares referred to in Article 13 (3) of the Agreement for the year 1992 shall be 40 %.
