AGREEMENT in the form of an exchange of letters concerning the provisional application of the Agreement on cooperation in the sea fisheries sector between the European Community and the Kingdom of Morocco initialled in Brussels on 13 November 1995

A. Letter from the Community

Sir,

With reference to the Agreement on cooperation in the sea fisheries sector between the European Community and the Kingdom of Morocco, initialled in Brussels on 13 November 1995, I have the honour to inform you that the European Community is ready to apply this Agreement on a provisional basis from 1 December 1995, pending the entry into force of the Agreement, provided that the Kingdom of Morocco is disposed to do likewise.

This is on the understanding that the first annual instalment of the financial compensation specified in Articles 2, 3, 4 and 5 of the Protocol to the Agreement shall be paid by 13 May 1996 at the latest.

Pending the issue of fishing licences in accordance with the provisions of the Agreement, vessels flying the flag of a Community Member State which are included in the lists drawn up to this effect in each fishing category shall be authorized to fish within the limits set out in the Protocol to the Agreement until 31 December 1995. In this case, the fees, observers' expenses and, where relevant, licence fees shall be paid no later than 10 December 1995.

I should be obliged if you would acknowledge receipt of this letter on such provisional application and confirm your agreement with its contents.

B. Letter from the Government of the Kingdom of Morocco

Gentlemen,

I am in receipt of your letter of today's date which reads as follows:

'With reference to the Agreement on cooperation in the sea fisheries sector between the European Community and the Kingdom of Morocco, initialled in Brussels on 13 November 1995, I have the honour to inform you that the European Community is ready to apply this Agreement on a provisional basis from 1 December 1995, pending the entry into force of the Agreement, provided that the Kingdom of Morocco is disposed to do likewise.
